It makes sense, actually. On the one hand you have freedom of speech and parody protection, and on the other you have blatant copyright ripoff.
I'm sure someone would be willing to argue that "Yay GOP" does add an expressive element, as would a picture of the GOP elephant with an exclamation point. But who would want to sell something like that?
Hrm..."Love me, love my [GOP Elelphant]" would probably make a pretty good t-shirt or bumper sticker...
